6. If there is any conflict between these terms and conditions and specific terms of use appearing on this website relating to specific material then the latter shall prevail.

If any of these terms and conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms and conditions are intended to be effective, then to the extent and within the jurisdiction which that term or condition is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and conditions and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.

8. No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

9. You confirm that, in accepting these terms and conditions, you have not relied on any representation save insofar as the same has expressly been included in these terms and conditions and you agree that you shall have no remedy in respect of any such representation.

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these terms and conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your customer account and/or your personal information.

11. These terms and conditions shall be governed and construed in accordance with English law and the courts of England and Wales shall have exclusive jurisdiction. The agreement between you and us shall be in English.

CONTRACT CREATION AND ELECTRONIC CONTRACTING

1. The technical steps required to create the contract between you and us are as
follows:

(a) You place the order for your products on the website by pressing the confirm order button at the end of the ordering process. You will be guided through the process of placing an order by a series of simple instructions on the website.

(b) We will send to you an order acknowledgement e-mail giving you an order reference number.

(c) As your product is shipped we will send you a despatch confirmation e-mail.

(d) Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the products ordered unless we have notified you that we do not accept your order.

2. Non-acceptance of an order may be a result of one of the following:

(a) The product you ordered being unavailable from stock.

(b) Our inability to obtain authorisation for your payment.

(c) The identification of a pricing or product description error.

(d) You not meeting our eligibility to order criteria.

3. Given that we process orders as soon as they are received, any request to cancel an order (or part thereof) by you shall be dealt with by us on a discretionary basis. We will try to accommodate your request to cancel, but as a general rule, if we do not receive a cancellation request via e-mail or telephone by the midday following the order placement, it is unlikely that we will be able to cancel your order.
4. If any item(s) of your order is/are out of stock:

(a) no payment shall be processed in respect of such out of stock item(s) until such item(s) come in;

(b) we shall have 28 days in which to supply you with such out of stock item(s), following which your order in respect of the same shall be cancelled;

(c) you may cancel your order at any time in respect of such item(s) during such 28 day period, unless and until you have received a despatch confirmation e-mail from us; and

(d) delivery charges in respect of out of stock items subsequently shipped to you shall be as set out below. We shall ship each out of stock item as it comes in and delivery charges will be recalculated accordingly on a per pack basis.

5. We reserve the right to withdraw any products from this website at any time and/or remove or edit any materials or content on this website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from this website whether or not that product has been sold; removing or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

6. To be eligible to purchase products on this website and lawfully enter into and form contracts on this website under English law you must:

(a) register by providing your real name, telephone number, e-mail address, payment details and other requested information;

(b) be over 18 years of age;

(c) stipulate a valid delivery address. This must be the same as your billing address unless you provide us with appropriate identification. (Please note if your delivery address is a PO box number, we are unable to ship your order via signed-for post); and

(d) possess a valid credit or debit card issued by a bank acceptable to us.

7. By placing an order, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

DESCRIPTION OF PRODUCTS

We shall take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the website as up to date as possible, the product information appearing on this website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a product until your order is accepted by us as set out above.

PAYMENT

1. All prices are exclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery charges as set out here. Payment can be made by any of the methods specified when you place your order.

2. You confirm that the credit or debit card that is being used is yours.

3. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

PERSONAL INFORMATION AND DATA PROTECTION

(a) the personal information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects;
